This Terms of Use Agreement is effective as of 11/08/2024.
SelfMaid Pvt Ltd ("SelfMaid/The Company”) (“Eyry”/The Brand) primarily owned, operates,
mediates, controls and manages the Services on the platform “www.eyry.in” (the "Website")
provided by it from its registered office at Sector 32, Shop No. 113, G-26, Gurugram, Haryana -
122001 (“Registered Office”) and 1271, Ground Floor, Lotus Avenue, Sector 43, Gurugram,
Haryana - 122003 ("Operations Office").
ACCEPTANCE OF TERMS
These terms and conditions cover the legal rights, obligations and responsibilities between you, the user, and EyRy, a company incorporated in India, operating from its Gurgaon Corporate Office, in respect of any services of selected third-party service providers (the "Professionals") offered for booking via our website www.eyry.in (the "Website") or a EyRy mobile application (the "App") including the classified advertisements, various email functions and Internet links, and all content and EyRy services available through the domain and sub- domains of EyRy and the online transactions between those users of the Website who are offering services (each, a "Service Professional") and those users of the Website who are obtaining services (each, a "User(s)"). We refer to the Website and the App together as the "EyRy Platform". EyRy will provide the services to its users under this agreement. The services constitute the provision of a technology platform that enables you as a user of EyRy Platform to:
Arrange and schedule Home based domestic help/driver and B2B/Corporate based – Office Boy, Chef/Cooks, Helper, Hospitality Staff, Pantry Boy, Driver and PG Supervisor etc. services with independent third party providers of those services, which are referred to here as “Service Professionals”.
The services provided by the Service Professionals are provided in their capacity as an independent body separate from that of the company and not in any principle - agent, employer - employee, partnership and/or joint venture, affiliation or any other fiduciary/legal relationship. The company solely acts as a technology medium between the Service Professionals and the users of EyRy platform.
The services are made available solely for the users for their personal, non-commercial use in domestic help, unless Eyry has agreed otherwise in a separate agreement.
You, the user, acknowledge that Eyry does not provide any of the services, mentioned above or hereafter and that all such services are provided by independent service professionals who are not employed by Eyry or any of its affiliates. Eyry accepts liability for the services and the Eyry Platform that it provides to you, the user, subject to these terms. Service professionals are responsible for the services they provide to you, the user.
Please read them carefully before you, the user, make a booking via the Eyry Platform, as they will apply to you, the user, and booking. By raising a requirement and making a booking via the Eyry Platform, you, the user, confirm that you accept these terms and conditions and that you agree to comply with them. If there is anything you do not agree with, please do not make a booking/raise a requirement.
You, the user, further agree that you authorize the transfer of payment for Services requested through the use of the Eyry Platform and certify that you are either a Service Professional or a prospective Service User agreeing to be bound by all terms and conditions.
Further additional terms and conditions, disclaimers and other policies are also considered as terms and conditions. It is obligatory for you, the user, to visit this page periodically to review the terms of use because they are binding on you.
MODIFICATIONS TO TERMS OF USE
AND/OR
PRIVACY POLICY:-
It shall be the sole discretion of the Company to make any changes or amendment to these Booking Terms and Conditions from time to time. You, the user, should check these Booking Terms and Conditions each time you wish to make a booking via the Eyry Platform, to make sure that you understand the terms which will apply at that time. Your use of the Eyry Platform following any amendment in the Terms and Conditions will deem that you assent to and accept any revised Terms and Conditions.
Self Maid Pvt. Ltd. (“company") may revise these terms of use, including www.eyry.in privacy statement at its discretion. The company does not have any obligation or responsibility to inform or intimate you in any manner, directly or indirectly, of the posting once updated or prior to such updation. Your use of the website (www.eyry.in) following any such modification constitutes your agreement to follow and be bound by the terms of use as modified. Any additional terms and conditions, disclaimers, privacy policies and other policies applicable to general and specific areas of this web site or to particular content are also considered as terms of use.
MEMBERSHIP AND ACCESSIBILITY:-
1. License To Access
Whilst Eyry grants you, the user, a non-exclusive, revocable license to use the Website, you will not copy or make derivative works of the Eyry Platform in any medium and you, the user, will not alter or modify any part of the Eyry Platform.
2. Membership Eligibility
(a) all registration information that you submit is true and accurate,
(b) Your use of the Eyry Platform and Services offered do not violate any applicable law or regulation.
(c) You, the user, are solely responsible for safeguarding your Eyry password and, if applicable, your Third-Party Site Password (collectively, "Passwords") at all times and shall keep your Passwords secure at all times.
(d) You, the user, agree that you will not misrepresent yourself or represent yourself as another user of the Website and/or the Services offered through the Website.
(e) You, the user, hereby expressly acknowledge and agree that you yourself and not Eyry will be liable for your losses, damages etc. (whether direct or indirect) caused by unauthorized use of your Account.
(f) You, the user, shall not use any automated system to access the Eyry Platform for any purpose.
(g) You, the user, shall not collect Service Professionals or Service Users information or otherwise misuse or misappropriate information or content.
(h) You, the user, shall not recruit, solicit, or contact in any form Service Professionals or Service Users for employment or contracting for a business not affiliated with Eyry without express written permission from Eyry.
(i) You, the user, warrant that you shall not take any action that unreasonably encumbers the Platform’s infrastructure or interferes with the proper working of the Eyry Platform.
EyRy’S WARRANTIES & REPRESENTATION:-
EyRy’s Declarations
Do not send us any confidential or proprietary information except for any personally identifiable information that we agree to keep confidential as provided in our Privacy Policy. We assume no obligation to protect confidential or proprietary information from disclosure and will be free to reproduce, use, and distribute the information to others without restriction. Also following are considered to be binding by/on the user(s):-
- The Company endeavors to provide the best of the Service Professionals.
- You, the user, may only make a booking if you are aged over the age of the legal majority in your jurisdiction. We may ask you to provide us with valid proof of identity in a form reasonably acceptable to us upon request.
- All Services shown on the EyRy Platform are subject to availability and the images and/or descriptions of the Services on the EyRy Platform are for illustrative purposes only – actual Services may vary from those images and/or descriptions.
- EyRy has the sole discretion to stop the services of the user, where the company finds the user mishandling, misusing the services and not providing a healthy working/living environment to the service professionals.
- The user agrees that the Company may take a little longer time than the expected one to assign the Service Professional as it takes time to allocate or assign Service Professionals for different Job Description.
- The company advise that you, the user exercise caution to protect your personal safety and property while interacting with the Service Professionals and keep checking the bags and belongings of the Service Professionals while they are coming and going out of your premises. EyRy shall not be held responsible for any kind of loss/ damages, theft incurs by any of the Service Professionals.
- In the case where the service professional causes any damage/loss, liabilities or expenses, EyRy shall not be held liable for the same. EyRy may from their end give this as a warning to the service professionals.
- The integrity of a third party service professional cannot be ascertained by EyRy.
- EyRy endeavors to collect/verify Government IDs/any other identification documents of the service professionals and the copies of the same are provided to the user and in case the user wishes to conduct police verification or criminal record check of the Service Professional than the same shall be done by the users at their end. However on a request made by a user EyRy may assist in the said police verification/criminal record check (separate charges will be applicable for the same).
- In case any Service professional is found to have any criminal record/criminal prosecution against them, then EyRy shall not be held responsible.
- You, the user, must treat Service Professionals courteously and lawfully, and ensure that the location in which they will be providing the Services is the safe and appropriate working environment for the Service Professional, in compliance with all applicable laws and regulations.
- In case you, the user, does not like the Service Professional who has been assigned to you, kindly give a notice of 30 days before you release the Service Professional so that we can find a suitable replacement. Replacement policy regarding replacement of service professional are mentioned in the services section, Please refer that.
- EyRy will provide replacement of Service Professional provided reasonable grounds are given for the same. EyRy will need appropriate time to find and allocate the suitable Service Professional.
- The user agrees that the Service Professional will not go through any harm, torture, harassment by you. If you make the service professional do any illegal, unlawful or violative act then only the user will be held liable for any such consequences.
- The user will be responsible for providing all the equipment and utensils required for cleaning and cooking and other work necessities.
- The address at which any service professional is deployed shall not be unilaterally changed temporarily or permanently, whatsoever for any reason, by the user without prior consent of the service professional. Such change, if any, shall be under mutual agreement between the user and the independent service professional. Any change or transfer in the address where the service professional was deployed shall be communicated to EyRy through mail.
- The user is advised to refrain from providing any advanced payments to the service professional. In case the user incurs any loss due to such advance payment, the same shall be responsibility of the user itself.
- During the course of employment of the service professional, the user shall arrange basic medical facilities for the Service Professional. In case of urgency the user shall provide immediate medical assistance and (if required) shall arrange Service Professional’s transportation to a medical practitioner or medical institution.
- Service professionals in any of the services mentioned above or hereinafter are "NOT" medical nurses or medical practitioners. Service professionals posses no medical knowledge. In case where a user opts for elderly care, child care or any other services related hereto, it shall not be deemed that the said service professionals posses medical or any other related know-hows.
- Eyry/SelfMaid shall not be held liable for any kind of dispute which may arise between the user or the service professional(s). In case a dispute arises between the user and the service professional, Eyry/SelfMaid, with the consent of both the parties, can try to amicably resolve the dispute. However, Eyry/SelfMaid is not a judicial authority and such attempts at dispute conciliation may not be deemed anything.
- Any online payment method will lead to a convenience fee (As per the user’s Bank). This fee has to be paid by the user.
- EyRy guide the Service Professionals regarding washing hands before and after service. They have been told to maintain no physical contact with the users while providing services and we request to the users for the same.
- (a) The subscription for 24 hours service shall remain valid for a period of (A) 1 year OR (B) 6 Months (Half-Yearly), which commences from the date on which a user confirms for the joining of the Service Professional.
- (b) Subscription amount shall not include monthly salary of the Service Professional(s). The user shall be paying monthly salary directly to the service professional.
- (c) Subscription amount shall only include (a) Assignment of a suitable Service Professional and (b) Two Service Professional replacements.
- (d) The maximum period of subscription shall be 12 months in a yearly subscription and 6 months in a half-yearly subscription.
- (e) The Subscription ends after 2 Service Professional replacements or when the term of the subscription expires, or when the subscription is terminated.
- (a) Under this subscription a user can avail a period of three days as a period of trial in order to analyze the skills/compatibility with the Service Professional and to experience the services rendered by the Service Professional. If a service professional is rejected before the end of such trial period the same shall not be counted as a confirmed candidate/replacement.
- (b) The sole and exclusive purpose of the trial period shall be the assessment of the compatibility of the Service Professional according to the user’s preferences.
- (c) The trial period in no case shall be free of cost. The salary of the service professional, for the trial period, shall be payable by the user which shall be calculated in accordance with the pre-determined per-day salary of the Service Professional(s) (Calculated on the basis of 28 Days of working).
- (d) After the expiry of the trial period, the user shall communicate to EyRy, about the confirmation or rejection of the Service Professional(s). In case no communication regarding confirmation or rejection of the service professional(s) is made after the expiry of the said trial period, it shall be deemed that the user has confirmed the appointment of the same service professional(s) which he/she has tried and shall be liable to pay the balance subscription amount.
- INR 30,000/- (Inclusive of 5% GST) shall be the annual subscription fee and INR 20,000/- (Inclusive of 5% GST) shall be the half-yearly subscription fee. Subscription amount shall be payable upfront immediately after communication of confirmation or immediately on the expiry of the above-mentioned trial period.
- The break-up of the above-mentioned subscription amount is as follows:-
- (i) Registration charges (Non-Refundable) – INR 2,625/-
- (ii) Service charges - 27,375/3 = 9,125/- per service professional in yearly and 17,375/3 = 5,791.67/- per service professional in half-yearly.
- (The above part of the payments is only here to understand. The company has a
non-refundable policy once the first service professional gets confirmed and post-trial
payment has been made)
- In case a user opts or intends to opt for three days trial period, an amount of INR 7500/- shall be deposited in advance. This entire advanced deposit amount shall be adjusted in the total amount of the above-mentioned subscription fee in case the user opts to obtain the subscription.
- Only an amount of INR 4875/- shall be refundable in case the user wishes to reject the subscription after the first trial of the Service Professional.
- An amount of INR 2625/- (Registration Charges) out of this advanced deposit shall be non-refundable in any case.
- The refund process of money by EyRy will take a maximum period of 25 days except in special circumstances where it can be exceed.
- No refund of any kind shall be made after confirmation of the first service professional. The company has a non-refundable policy in any case, after the confirmation of the first service professional.
- Pause of subscription – in case a user requests to pause/hold his/her subscription after availing the first or second confirmed service professional and the previous one leaves or quits, the remaining balance period and number of the service professional’s replacement could be availed by the user after the period of such pause. Such pause cannot be availed while the service professional is providing his/her services to the user. Pause can be availed only after a due request is received from the user to the company.
- All payments made by users in the form of “Credits” are non-interest bearing. Unutilized and unclaimed "Credits" for a period of more than 180 days from the date of purchase of "Credits" shall expire and stand forfeited. No refunds of credits will be processed after the expiry date.
- In case the user directly hires service professional(s) introduced by EyRy, such user
shall be liable to pay the full amount of INR 30,000/- as damages or
else EyRy reserves the right to recover this amount through appropriate legal proceedings or
EyRy can
nullify the pre-trial amount (against registration and service charges) and cancel the
subscription for further services.
- The user obtaining the subscription can avail up to 2 Service Professional replacements during the active period of subscription. No replacements shall be provided after expiry of subscription period.
- There shall be in no case change in the Monthly salary of the replaced Service Professional (s). Any negotiations (pertaining to monthly salary of the Service Professional) made between the user and the Service Professional(s) shall be done in their personal capacity. EyRy shall not be subject to any of those negotiations.
- In a case, if any service professional which has been confirmed by the user (Please refer to point number 4 of the Trial’s section) leaves, quits or is terminated for any reason after the trial period. In that case, the company will provide the replacement according to the subscription and henceforth in this way every replacement shall be counted.
- In case of a replacement kindly give us a notice of 30 days before you release the service
professional or if the service professional leaves suddenly without any notice then EyRy will
need appropriate time to find and allocate the suitable service professional.
- No replacement or refunds will be provided to the user in case the Service Professional leaves or quits or refuses to work with the user due to ill behavior, refusal to pay or bad working conditions.
- No replacements will be provided to the user in case the service professional is taking any kind
of leaves (emergency, medical, monthly, festivals, etc.) from the work and is willing to join
back after the leaves.
- Police registration of the assigned Service Professional(s) shall be done by the Company after receiving the post-trial payment and confirmation of the service professional in the new registration and only confirmation in the replacement process. (Only in Gurugram, Haryana).
- The user/customer shall be responsible for covering the expenses associated with the pickup and
drop of the service professional during the initial hiring process and in the event of
replacements. However, the user/customer shall not be liable for the service professional's
traveling costs in situations where the service professional takes leave or time off during the
period of their employment or in cases of part-time work.
- Any medical facilities,if necessary, provided by the Company to the Service Professional will only be given before the commencement of the subscription period and not throughout the period.
- The user shall provide residence to the Service Professional in his/her own dwelling place, any place in vicinity of his/her house or any other place where the user make use of the Service Professional’s service(s). Any cost pertaining to the residence, i.e. rent, electricity, water, maintenance charges, or any other charge/cost (not mentioned herewith), of the Service Professional shall in totality be borne by the user. Such a residence shall consist of basic facilities like toilet, kitchen etc. and shall in no case be hazardous or near hazardous place/material.
- The user shall provide food and drinking water to the Service Professional. Such food and water shall maintain minimum standard of hygiene and quality which is fit for human consumption. Any cost pertaining to the basic food and water consumption of the Service Professional shall in totality be borne by the user during the entire course of the Service Professional’s employment.
- During the course of employment of the service professional, the user shall arrange basic medical facilities for the Service Professional. In case of urgency the user shall provide immediate medical assistance and (if required) shall arrange Service Professional’s transportation to a medical practitioner or medical institution.
- The user in no case can deprive any Service Professional of his/her fundamental rights. Any Service Professional, in no case, can be exploited or overburdened with work. The user shall grant sufficient time for sleep, rest and other basic necessities.
- There shall be two days of holidays every month for Service Professionals.
- The subscription for Part Time 6/8/10/12 Hours service shall remain valid for a period of (A) 1 year OR (B) 6 Months, which commences from the date on which a user confirms for the joining of the Service Professional.
- Subscription amount shall not include monthly salary of the Service Professional(s). The user shall be paying monthly salary directly to the maid(s). Subscription amount shall only include (a) Assignment of a suitable Service Professional and (b) Four Service Professional replacements.
- The period of subscription shall be 12 months in a yearly subscription and 6 Months in a half-yearly subscription.
- The Subscription ends after 4 Service Professional replacements or when the term of the subscription expires, or when the subscription is terminated.
- Under this subscription a user can avail a period of three days as a period of trial in order to analyze the skills/compatibility with the Service Professional and to experience the services rendered by the Service Professional. If a service professional is rejected before the end of such trial period the same shall not be counted as a confirmed candidate/replacement.
- The sole and exclusive purpose of the trial period shall be assessment of the compatibility of the Service Professional according to the user’s preferences.
- The trial period in no case shall be free of cost. The salary for the trial period shall be payable by the user which shall be calculated in accordance with the pre-determined per-day salary of the Service Professional(s) (Calculated on the basis of 28 Days of working).
- After the expiry of the trial period, the user shall communicate to EyRy, about the confirmation or rejection of the Service Professional(s). In case no communication regarding confirmation or rejection of the service professional(s) is made after the expiry of the said trial period, it shall be deemed that the user has confirmed the appointment of the same service professional(s) which he/she has tried and shall be liable to pay the balance subscription amount.
- INR 15,000 + 5% GST shall be the annual subscription fee and INR 10,000/- + 5% GST shall be the half-yearly subscription fee. The subscription amount shall be payable upfront immediately after communication of confirmation or immediately on the expiry of the above-mentioned trial period.
- The break-up of the above-mentioned subscription amount is as follows:-
(a) Registration charges (Non-Refundable) – INR 2,500/- + 5% GST
(b) Service charges - 12,500/5 = 2,500/- per service professional in yearly or 12,500/12 = 1,041/- per month charges and 7,500/5 = 1,500/- per service professional in half-yearly or 7,500/6 = 1,250/- per month charges. - (The above part of the payments is only here to understand. The company has a
non-refundable policy once the first service professional gets confirmed and post-trial has
been made.)
- In case a user opts or intends to opt for three days trial period, an amount of INR 5000 + 5% GST shall be deposited in advance. This entire advanced deposit amount shall be adjusted in the total amount of the above-mentioned subscription fee in case the user opts to obtain the subscription.
- Only an amount of INR 2500/- shall be refundable in case the user wishes to reject the subscription after the first trial of the Service Professional.
- An amount of INR 2500/- + 5% GST (Registration Charges) out of this advanced deposit shall be non-refundable in any case.
- The refund process of money by EyRy will take a maximum period of 25 days except in special circumstances where it can be exceeded.
- No refund of any kind shall be made after confirmation of the first service professional. The company has a non-refundable policy in any case, after the confirmation of the first service professional.
- The pause of subscription – – In case a user requests to pause/hold his/her subscription after availing of the services of the first to fourth confirmed service professionals and the previous one leaves or quits, the remaining balance period and the number of the service professional’s replacement could be availed by the user after the period of such pause. Such pause cannot be availed while the service professional is providing his/her services to the user. The pause can be availed only after a due request is received from the user to the company.
- All payments made by users in the form of “Credits” are non-interest bearing. Unutilized and unclaimed "Credits" for a period of more than 180 days from the date of purchase of "Credits" shall expire and stand forfeited. No refunds or credits will be processed after the expiry date.
- In case the user directly hires service professional(s) introduced by EyRy, such user
shall be liable to pay the full amount of Rs. 15,000/- as damages or else EyRy
reserves the right to recover this amount through appropriate legal proceedings or EyRy can
nullify the pre-trial amount (against registration and service charges) and cancel the
subscription for the further services.
- The users obtaining the subscription can avail up to 4 Service Professional replacements during the active period of subscription. No replacements shall be provided after expiry of subscription.
- There shall be in no case change in the Monthly salary of the replaced Service Professional(s). Any negotiations (pertaining to monthly salary of the Service Professional) made between the user and the Service Professional(s) shall be done in their personal capacity. EyRy shall not be subject to any of those negotiations.
- In a case, if any service professional which has been confirmed by the user (Please refer to point number 4 of the Trial’s section) leaves, quits or is terminated for any reason after the trial period. In that case, the company will provide the replacement according to the subscription and henceforth in this way every replacement shall be counted.
- In case of a replacemnet kindly give us a notice of 30 days before you release the service
professional of if the service professional leaves suddenly withour any notice then EyRy will
need appropriate time to find and allocate the suitable service professional.
- No replacement will be provided to the user in case the Service Professional leaves or quits or refuses to work with the user due to ill behavior, refusal to pay or bad working conditions.
- No replacements will be provided to the user in case the Service Professional is taking any kind
of leaves (emergency, medical, monthly, festival, etc.) from the work and is willing to join
back after the leaves.
- Police registration of the assigned Service Professional(s) shall be an optional service for the users *(Subscription Charges does not include Police Registration charges).
- Any medical facilities, if necessary, provided by the Company to the Service Professional will only be given before the commencement of the subscription period and not throughout the period.
- The user shall provide food for one time (lunch) and drinking water to the Service Professional. Such food and water shall maintain minimum standard of hygiene and quality which is fit for human consumption. Any cost pertaining to the basic food and water consumption of the Service Professional shall in totality be borne by the user during the entire course of the Service Professional’s employment.
- During the course of employment of the service professional, the user shall arrange basic medical facilities for the Service Professional. In case of urgency the user shall provide immediate medical assistance and (if required) shall arrange Service Professional’s transportation to a medical practitioner or medical institution.
- The user in no case can deprive any Service Professional of his/her fundamental rights. Any Service Professional, in no case, can be exploited or overburdened with work. The customer shall grant sufficient time for break and other basic necessities.
- There shall be two days of holidays every month for Service Professionals.

(a) Full-Time (Live in)
-
(b) Part-Time 8/10/12 Hour
- (a) The subscription for Full-Time (Live in) and Part-Time 8/10/12 Hours service shall remain valid for a period of 2 months (60 Days), which commences from the date on which a user confirms for the joining of the Service Professional (Trial Date of the Service Professional shall be considered as the first (1 st ) day of the subscription).
- (b) Subscription amount shall not include monthly salary of the Service Professional(s). The user shall be paying monthly salary directly to the service professional. Subscription amount shall only include - Assignment of a suitable Service Professional.
- (c) The Subscription ends after 1 Service professional replacement or when the term/tenure of the subscription expires, or when the subscription is terminated.
- Under this subscription a user can avail a period of two (2) days as a period of trial in order to analyze the skills/compatibility with the Service Professional and to experience the services rendered by the Service Professional. If a service professional is rejected before the end of such trial period the same shall not be counted as a confirmed candidate/replacement.
- The sole and exclusive purpose of the trial period shall be assessment of compatibility of the Service Professional according to the user’s preferences.
- The trial period in no case shall be free of cost. The salary for the trial period shall be payable by the user which shall be calculated in accordance with predetermined per day salary of the Service Professional(s) (Calculate on the basis of 28 Days of working).
- After the expiry of the trial period, the user shall communicate to EyRy, about the confirmation or rejection of the Service Professional(s). In case no communication regarding confirmation or rejection of the service professional(s) is made after the expiry of the said trial period, it shall be deemed that the user has confirmed the appointment of the same service professional(s) which he/she has tried and shall be liable to pay the balance subscription amount.
- “The Amount (in INR and exclusive of GST) equivalent to the decided salary (in INR and exclusive of GST) of the service professional during interview” shall be the one time subscription fee (exclusive of the GST).
- Subscription amount shall be payable upfront immediately after communication of confirmation or immediately on expiry of the above mentioned trial period.
- The break-up of the above mentioned subscription amount is as follows:-
(i) Processing charges (Non Refundable) = INR 2,500 + 5% GST
(ii) Service charges = Total Decided Salary (+ GST) - Processing Charges. - (Eg. - The decided salary of the service professional is INR 25,000/-. Then the subscription fee is also INR 25,000/-. The above part of the payments is only here to understand. The company has a non-refundable policy once the service professional gets confirmed and post-trial payment has been made)
- In case a user opts or intends to opt for two (2) days trial period, an amount equivalent to INR 15000 + GST of the subscription fee shall be deposited in advanced. This entire advanced deposit amount shall be adjusted in the total amount of the above-mentioned one time subscription fee in case the user opts to obtain the subscription.
- (The above part of the payments is only here to understand. The company has a
non-refundable policy once the first service professional gets confirmed and post-trial has
been made.)
- The amount of INR 2500 + 5% GST shall be Non-refundable in any case.
- The refund process of money by Eyry will take a maximum period of 25 days except in special circumstances where it can be exceed.
- No refund of any kind shall be made after confirmation of the first service professional. The company has a non-refundable policy in any case, after the confirmation of the first service professional.
- All payments made by users in the form of “Credits” are non-interest bearing. Unutilized and unclaimed "Credits" for a period of more than 180 days from the date of purchase of "Credits" shall expire and stand forfeited. No refunds of credits will be processed after the expiry date.
- In case the user directly hires service professional(s) introduced by Eyry, such user shall be liable to pay the full amount equivalent to the decided salary of confirmed/hired service professional as damages or else Eyry/Selfmaid reserves the right to recover this amount through appropriate legal proceedings or Eyry/Selfmaid can nullify the pre-trial amount (against registration and service charges) and cancel the subscription for further services.
- In a case, if any service professional which has been confirmed by the user leaves, quits after the trial period and within the 60 days of his/her joining. In that case, the company will provide the replacement (Only 1) just to cover the 2 Months service plan that is according to the subscription.
- The users obtaining the subscription can avail up to 1 Service professional replacement during the active period of the subscription. No replacements shall be provided after expiry of the subscription.
- There shall be in no case change in the Monthly salary of the replaced Service professional. Any negotiations pertaining to the monthly salary of the service professional made between the customer and the Service professional shall be done in their personal capacity. Eyry/Selfmaid Pvt. Ltd. shall not be subject to any of those negotiations.
- In a case, if any service professional who has been confirmed by the user (Please refer to point number 4 of the Trial’s section) leaves, quits or is terminated for any reason after the trial period. In that case, the company will provide the replacement according to the subscription and henceforth in this way every replacement shall be counted.
- In case of a replacement kindly give us a notice of 30 days before you release the service
professional or if the service professional leaves suddenly without any notice then EyRy will
need appropriate time to find and allocate the suitable service professional.
- No replacement or refunds will be provided to the user in case the Service Professional leaves or quits or refuses to work with the customer due to ill behavior, refusal to pay or bad working conditions.
- No replacements will be provided to the user in case the Service Professional is taking any kind
of leaves (emergency, medical, monthly, festivals, etc.) from the work and is willing to join
back after the leaves.
- Police registration of the assigned Service Professional(s) shall be done by the Company after receiving the post-trial payment and confirmation of the service professional in the new registration and only confirmation in the replacement process. (Only in Gurugram, Haryana).
- The user/customer shall be responsible for covering the expenses associated with the pickup and drop of the service professional during the initial hiring process and in the event of multiple trials/replacements. However, the user/customer shall not be liable for the service professional's traveling costs in situations where the service professional takes leave or time off during the period of their employment or in cases of part-time work.
- Any medical facilities, if necessary, provided by the Company to the Service Professional will only be given before the commencement of the subscription period and not throughout the period.
- In case of Full-Time (live in) service, the user shall provide residence to the Service Professional in his/her own dwelling place, any place in vicinity of his/her house or any other place where the user make use of the Service Professional’s service(s). Any cost pertaining to the residence, i.e. rent, electricity, water, maintenance charges, or any other charge/cost (not mentioned herewith), of the Service Professional shall in totality be borne by the user. Such a residence shall consist of basic facilities like toilet, kitchen etc. and shall in no case be hazardous or near hazardous place/material.
- In case of Full-Time (live in) service, the user shall provide food and drinking water to the Service Professional. Such food and water shall maintain minimum standard of hygiene and quality which is fit for human consumption. Any cost pertaining to the basic food and water consumption of the Service Professional shall in totality be borne by the user during the entire course of the Service Professional’s employment.
- In case of Part-Time 8/10/12 Hours service, the user shall provide food for one time (lunch or dinner) and drinking water to the Service Professional. Such food and water shall maintain minimum standard of hygiene and quality which is fit for human consumption. Any cost pertaining to the basic food and water consumption of the Service Professional shall in totality be borne by the user during the entire course of the Service Professional’s employment.
- During the course of employment of the service professional, the user shall arrange basic medical facilities for the Service Professional. In case of urgency the user shall provide immediate medical assistance and (if required) shall arrange Service Professional’s transportation to a medical practitioner or medical institution.
- The user in no case can deprive any Service Professional of his/her fundamental rights. Any Service Professional, in no case, can be exploited or overburdened with work. The user shall grant sufficient time for sleep, rest and other basic necessities.
- Eligibility: The offer is available exclusively to users of the Eyry platform.
- Modifications: The Brand and/or the Eyry Platform reserve the right to modify, suspend, terminate, or withdraw the offer at any time without prior notice.
- Voluntary Acceptance: Users acknowledge that acceptance of any offer or service is entirely voluntary.
- Force Majeure: The offer may be withdrawn at the discretion of the Brand and/or the Eyry Platform in the event of force majeure.
- Liability: The Eyry Platform is not liable for any loss, injury, or other liability arising from products or services related to or made available by Brands/Third-Party Vendors.
- Endorsement: The Eyry Platform does not endorse any products or services sold on the platform by third parties or brands.
- Responsibility: The Brand/Third-Party Vendor is solely responsible for the delivery of services, warranties, and any claims related to those services.
- Data Sharing: By accepting or placing an order, users consent to the sharing of their contact details, such as mobile number, email ID, and address, for the purpose of fulfilling the offer. Communication may occur via SMS, email, calls, and/or WhatsApp by the Eyry Platform. Any information collected and shared by Eyry will comply with the platform’s privacy policy, and the Brand’s processing of such information will align with its terms of use/privacy policy.

Modification or Cessation

Termination by the Company
You, the user hereby acknowledge and agree that Eyry/SelfMaid, in its sole and absolute discretion, has the right to deactivate your Account or otherwise terminate your access to or participation in the use of the Eyry Platform (or any part thereof), without notice, for any reason or if Eyry/SelfMaid believes that you have violated any provision of the Terms and Conditions. You may cancel your contract with the Eyry Platform, with or without any prior intimation to Eyry by accessing the "Deactivate Account" on the Eyry Platform. You, the user acknowledge and agree that Eyry shall not be liable to you or any third party for any termination of your Account.

Termination by the User
You, the user may cancel your use of the website and/or terminate the Terms of Use with or without cause at any time by letting us know about any kind of deactivation. The Company will consider your account as a deactivated account if your account is not operated for another 180 days.

- Registration Charges/Processing Charges: Registration charges/Processing Charges are the basic charges for the company in which the company puts efforts to research and endeavors the best/suitable service professional, according to user’s requirement.
- Service Charges: Charges, apart from the registration charges, shall not be considered as a manpower commission. The company provides a technology platform to arrange and schedule home-based domestic help/driver services with independent third-party providers of those services, which are referred to here as “Service Professionals”. The detailed description in the services section, about the charges is for the better understanding/clarity of the users.
- Third-Party Beneficiaries: You, the user, hereby agree that there shall be no third-party beneficiaries to the Terms of Use, except as otherwise expressly provided in the Terms of Use.
- Notice: You, the user, agree that Eyry/SelfMaid may or may not provide you with notices, including those regarding changes to the Terms and Conditions, by email, regular mail, or postings on the Eyry Platform. You may visit the terms and conditions regularly to keep yourself updated.
- Entire Terms and Conditions: The Terms and Conditions, together with the Privacy Policy and any other Additional Policies, shall constitute the entire agreement between you, the user, and Eyry/SelfMaid. Services are delivered on a best-effort basis and are subject to various limitations, including those imposed by technology, governmental and public/private infrastructure, regulations, and access policies defined by third parties.

Once a service professional candidate is duly confirmed by the user for appointment the same shall be counted as an appointment/replacement. No temporary replacement(s) of service professionals shall be provided.
PROHIBITIONS WITH RESPECT TO SERVICES
While using the Website, you, the user shall not violate any laws, third-party rights, Account Policies, or any provision of the Terms and Conditions or circumvent our fee structure, the billing process, or fees owed to Eyry.
FEEDBACKS
As a user of the Eyry Platform, you agree to use careful, prudent, and good judgment when leaving Feedback for another user. If you violate any of the rules in connection with leaving Feedback, Eyry in its sole discretion, may take any of the following actions: (i) cancel your Feedback or any of your Postings; and/or (ii) suspend your Account. In the event of any dispute between users of the Website concerning Feedback, Eyry/SelfMaid shall be the final arbiter of such dispute.
CONSENT FOR REACHING OUT VIA PHONE CALL, SMS, EMAIL OR ANY OTHER FORM OF ELECTRONIC COMMUNICATION
You, the user hereby agree that your registration with Eyry/SelfMaid shall be deemed to be your consent to be contacted on (i) the mobile number shared by you even if you have opted out of receiving promotional calls and messages and (ii) by way of SMS or email notifications or messages in any other electronic form.

USE OF SUBMITTED CONTENT
Eyry may allow the hosting, sharing, and/or publishing of any communications submitted by you, including without limitation, your Profile, any Feedback, and all other Submitted Content. You understand that Eyry does not guarantee any confidentiality with respect to any Submitted Content. You agree that Eyry shall be free to use or disseminate such freely searchable Submitted Content on an unrestricted basis for the purpose of providing the Services. Any communications, comments, suggestions, or related materials sent to Eyry, (collectively, "Suggestions"), recommending changes to the Platform, shall be treated as non-confidential.
MODIFICATIONS TO OR TERMINATION

INDEMNIFICATION
You, the user, agree to indemnify and hold us and (as applicable) our parent, service professionals, contractors, managers, successors, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms and Conditions, your violation of any law, or your violation of the rights of a third party, including the infringement by you of any intellectual property or other rights of any person or entity.
TAXES
You, the user, understand that SelfMaid with its platform www.eyry.in (“Website”) is acting solely as an intermediary for the collection of subscription charges and fees between a Service User and a Service Professional who choose to enter into an Agreement for Service with you. Because state and local tax laws vary significantly, you understand and agree that you are solely responsible for determining your own tax requirements. Also, payments made by the users are inclusive of 5% GST. You, the user, do not need to pay any extra hidden charges. All the charges are clearly mentioned in the service's sections.
DISPUTE RESOLUTION
You, the user, and Eyry/Self Maid Pvt. Ltd. hereby agree that any claim or controversy at law and equity that arises out of the Terms and Conditions or the Eyry Platform will be resolved via resolution processes when the user writes to us via e-mail at support@eyry.in. The dispute shall be resolved through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation. The Terms of Use shall be governed in all respects by the laws of India and any legal proceeding arising out of this Agreement will occur exclusively in the courts located in New Delhi, India.
LIMITATIONS OF LIABILITY
Self Maid Pvt. Ltd./Eyry, managers, agents, contractors, employees, etc. shall not, in any case, be liable to you, the user, for any direct, indirect, incidental, special, punitive, consequential, or exemplary damages (including but not limited to loss of business, revenue, profits, use, data, or other economic advantages) whatsoever resulting from any access to or use of the website, any unauthorized use of your personal information, mistakes or errors of data, interruption through viruses by a third party, defamatory or illegal conduct of the third party. You, the user, further acknowledge and agree that Eyry/SelfMaid shall not be liable for any direct, indirect, incidental, special, punitive, consequential, or exemplary damages (including but not limited to loss of business, revenue, profits, use, data, or other economic advantages) whatsoever resulting from or relating to any contract between website users entered into independently of the website.
UNFORESEEABLE CIRCUMSTANCES
The Company here removes liability for natural and unavoidable catastrophes that interrupt the expected course of events and restrict participants from fulfilling obligations. Neither SelfMaid/Eyry nor you, the user, shall be liable to the other for any delay or failure in performance under the Terms and Conditions, other than payment obligations, arising out of a cause beyond its control and without its fault or negligence. These unavoidable and natural catastrophes may include but are not limited to fires, floods, earthquakes, strikes, unavailability of necessary utilities, blackouts, acts of God, acts of declared or undeclared war, acts of regulatory agencies, or national disasters.
